MAYOR & COUNCIL MEETING   BARNEGAT LIGHT MAY 18, 2005

 

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 3, 2005 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 3, 2005, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 3, 2005.

The Mayor asked if anyone had anything to talk about.  Harry Howard mentioned the letter regarding Fifth Street.  He said that He and Bob White who wrote the letter went up to look at the situation and that Al Oros had taken care of everything.  He also mentioned how beautiful the garden at the museum is and complimented the ladies for all the hard work at keeping it up.  On a motion by Bossi, seconded by Reynolds and carried by all, there was a 10 minute recess.

COMMITTEE REPORTS:

 

FINANCE:  GEORGE WARR had noting to report. 

 

BEACHES AND PARKS:  DOROTHY REYNOLDS reminded everyone that preseason badges are on sale until June 15th.  She hoped to have as many lifeguards as can make it at the next meeting.  At least have Don Adams there. She reminded everyone that no dogs are allowed on the beaches of Barnegat Light at this time.  She also updated us on the Piping Plovers.

 

WATER AND SEWER:  MICHAEL SPARK was absent so the Mayor asked that the Water/Sewer report be made a part of the minutes.

 

DOCKS AND HARBORS:  DAVE BOSSI said the bulkhead is almost finished. The bulkhead at the condos is coming along.  The State will be starting at 4th Street with their bulkheading project.  There will be a Storm Ready meeting at the EOC on the 23rd at 7:00pm.  There will be a guest speaker.  Dave also gave a Coast Guard Cottage update.    

PUBLIC SAFETY:  JIM MORRISON was absent so the mayor asked that the Court and Police Reports be made a part of the minutes.  The hash marks should be in place prior to the opening of the beaches.  Gail had spoken to Lt. Verbe and he double checked with the county.  The truck route was discussed as well.

 

PUBLIC WORKS:  HARRY HOWARD mentioned the road project at 6th and 7th streets and it is DOT funded.  He also mentioned the 5th Street Beach Access problem, he thanked Al Oros for taking care of same.  He than mentioned the view obstruction report – Gail Wetmore told him this being handled by Al Oros and thanked Al for a job well done.  Next, Harry said he has a brochure from Oyster Creek that he thinks is very worthwhile.  Gail said Kathy Contreras has additional copies.

 

OPEN PUBLIC SESSION:  On a motion by Warr, seconded by Bossi and carried by all, the public session was opened.  Mary Jane Preiser discussed the truck route.  Gene Sharpless asked about the guard rail at 4th Street.  Harry Howard will ask Art to speak with the county about having it removed.  Sarah Lambert read from a paper that she had prepared regarding the Southern Regional School Issue.  She said there has been much discussion both in the press and by the citizens about the reconsidering of the funding issue.  She said the members of the taxpayer’s association have seen the full minutes on the Borough’s website and the taxpayer’s web site.  She said they had their meeting in the Fire House last Saturday.  She personally informed the Mayor and invited Dave Bossi to speak of this and other developments at the Council.  The Mayor asked if Dottie Reynolds had spoken.  She said she gave her opinion.  Dave said he wasn’t present to hear it.  There were several aspects that disturbed the members.  One, that almost the exclusive public discussion of this matter was concentrated solely on the pros and cons of dissolving Southern Regional School District.  Taxpayers on Saturday were concerned with the basis for the Borough’s decision not to participate in the interlocal agreement.  They wondered if there would be greater costs to the taxpayers of Barnegat Light in joining Beach Haven, Harvey Cedars, and Long Beach Township than if it did not.  They felt the Borough’s decision not to participate is based on a gamble.  Sarah said in the 2005-06 school year Barnegat Light will pay 6% of the costs.  She felt that if Beach Haven, Harvey Cedars and Long Beach Township were no longer constituent members our costs would increase.  The Mayor took exception to this and asked her who says this is going to happen.  Sarah said no one says it.  The Mayor said it has to go before the school board for a referendum.  Sarah said that’s right.  The Mayor asked her if she had ever gone to a meeting of the local school board. She said she had not.  He addressed Sarah as Dr. and said he knew she was very smart and wrote great papers – great stories and all that but he wanted to know where the referendum comes from.  Sarah sad that we will not know unless – and the Mayor said tell him who is going to put the referendum on the table.  He said he thinks she is looking at the wrong board.  You should go to the school board, not the town.  Sarah said that’s what everybody says, but the town pays the taxes.  The Mayor asked her where does the bill come from?  The Mayor said that our state senator said there is no way we will win until they change the law.   Live in an ocean front and pay less taxes - ?  Sarah felt we should be getting a seat at the table.   The Mayor said we do have a seat at the table. She mentioned the Manchester decision and that the commissioner of Education was directed by the judge – Dottie Reynolds said the judge can tell the commissioner that he has to reapportion.  She said that case is over and done with. Dave Bossi asked Sarah to bring us evidence that we won’t be included. He said the majority of council does not believe that is the case.  We have been given nothing to indicate it.  What is the basis for this presumption and why is yours different or better that this council’s? We are privy to more information.  (This was meant for all issues)  Dave also  said he thinks that the taxpayer’s (at the Saturday meeting) think that the Mayor and Council don’t pay taxes – some of the council have a lot of property and all of them pay taxes.  At this point the Mayor said  rather than spend $100,000 for a study that goes no where, he would rather put a bathroom at the bay beach.  Dave Bossi said the point is he felt that Sarah was not respecting this council by her thoughts.  The discussion could go on and on, so the Mayor said that this is our town, our council, we voted on the issue and let’s wait and see what happens.  Next to speak was John Michel.  He said he had come to the December meeting when we put the money into the budget and said we were going to join.  That is why he came now. He had read that we didn’t join in the study. He said maybe you are right, the School Board is the right place.  He said he would be welcome to spending the money at the bay beach.  He felt we are loosing retired people due to high taxes.  You could have the Hamptons here.  If Sarah is right and 3 towns get to leave and we don’t – you’ll have a lot of Taxpayers that will not be happy.  George Warr said if relief comes, it comes for the entire island.  The Mayor said if the School District dissolves, the entire school district has to dissolve.  George Warr said that school funding can not continue to be based upon real estate values.  That’s the answer, but it is not solvable in this room.  Dottie Reynolds said it would be 50 years before things changed in the state with the way that schools are funded.  Gene Sharpless asked about other avenues and was told by the Mayor that those discussions are not ongoing at this time.  Harry Selover said he felt we were loosing tract.  The school is doing a great job.  It is the 4th largest in the state.  We have 37 kids who go to Southern.  The point he’s trying to make here is look at the quality of education and how we keep affording it.  Not putting in the $3,000.00 send a message that we value the educational programs that the school is offering.  If there were to be a legal battle, he sees massive problems.  Dottie mentioned that the median household income in Barnegat Light is $52,300 and in Stafford it is $52,269.  The Mayor said at one point Stafford was subsidizing us, when Sarah said we are subsidizing them. He had some color graphs from Carl Block and will find them so that Sarah can see them.   Fran Puskas mentioned that real estate prices are rising faster on the mainland than they are on the island at this time.  The Mayor mentioned affordable housing and said that we would have to provide it in another town, because we do not have open space to do so in Barnegat Light.   On a  motion by Warr, seconded by Bossi and carried by all the public portion was closed.

ORDINANCE 05-12

 

          AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE RECONSTRUCTION OF WEST 17th, 28th & 29th STREETS AND APPURTENANCES THERETO, AND APPROPRIATING $150,000.00 THEREFOR, AND PROVIDING FOR THE ISSUANCE OF $142,500.00 IN GENERAL IMPROVEMENT BONDS OR NOTES OF THE BOROUGH OF BARNEGAT LIGHT TO FINANCE THE SAME.

 

The Clerk read the above and the Mayor asked for a motion to introduce same on first reading and publish according to law.  Bossi moved to do so, seconded by Reynolds.

AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING ELECTRICAL UPGRADES AND REPAIRS TO WATER WELL # 4, AND APPROPRIATING $10,000.00 THEREFOR, AND PROVIDING FOR THE ISSUANCE OF $9,500.00 IN GENERAL UTILITY BONDS OR NOTES OF THE BOROUGH OF BARNEGAT LIGHT TO FINANCE THE SAME.

RESOLUTION 05-097

 

                        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE EXECUTION OF PERMIT APPLICATION FOR THE OCUA INTERCEPTOR REHABILITATION PROJECT.

 

            WHEREAS, the Borough of Barnegat Light is a waterfront community which is subject to various regulatory agencies; and

 

            WHEREAS, the Ocean County Utilities Authority has applied for an NJDEP Treatment Works Approval Permit in connection with its Interceptor Rehabilitation Project; and

 

            WHEREAS, said permit application requires the local governing body to consent to the same; and

 

            WHEREAS, it is the desire of the Mayor and Borough Council of the Borough of Barnegat Light to authorize the execution of the Statement of Consent to the Ocean County Utilities Authority application for an NJDEP Treatment Works Approval Permit in connection with its Interceptor Rehabilitation Project.

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

1.                  That the Mayor and Borough Clerk are hereby authorized to execute the NJDEP Treatment Works Approval Permit Application, the Ocean County Utilities Authority Application, and all other necessary applications for other-agency approvals for the North Light Harbor development project.

 

                        2.         That a certified copy of this resolution shall be supplied to the Ocean County Utilities Authority.

                        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE EXECUTION OF the 2006 NJDOT Local Aid Application.

 

            WHEREAS, the Borough of Barnegat Light annually receives State aid for the reconstruction of its roadways; and

 

            WHEREAS, the Borough plans to reconstruct West 6th Street and West 29th Street in 2006; and

 

            WHEREAS, the State aid application requires the local governing body to authorize the same; and

 

            WHEREAS, it is the desire of the Mayor and Borough Council of the Borough of Barnegat Light to authorize the execution of the 2006 application to the New Jersey Department of Transportation, Transportation Trust Fund, Local Aid Program, for its 2006 Road Reconstruction/Improvement Project.

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

2.                  That the Mayor and Borough Clerk are hereby authorized to execute the 2006 application to the New Jersey Department of Transportation, Transportation Trust Fund, Local Aid Program, for its 2006 Road Reconstruction/Improvement Project, for the improvement of West 6th Street (from Central Avenue to Broadway) in the amount of $69,190.00, and West 29th Street (from Central Avenue to Bayview Avenue) in the amount of $59,042.50, for a total aid application of $123,233.00.

     WHEREAS, the Finance Committee of the Borough of Barnegat Light has examined the vouchers presented for payment,

    

 

     NOW, THEREFORE, BE IT RESOLVED, that the approved vouchers amounting to $1,667,509.37 authorized to be paid upon verification of the Treasurer that there is sufficient money in the appropriated accounts, subject to adequate signatures and funding.

          RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING AN AMENDMENT TO THE 2005 BUDGET TO ALLOW FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE AND APPROPRIATION PURSUANT TO N.J.S.A. 40A:4-87 (CHAPTER 159) FOR THE CLEAN COMMUNITIES GRANT.

 

 

          WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any local unit when such item shall have been made available by any public or private funding source and the amount thereof shall not have been determined at the time of the adoption of the budget; and

 

          WHEREAS, N.J.S.A. 40A:4-87 further provides that the Director may approve the insertion of an appropriation item of an amount equal to any such special item of revenue making such item of revenue available for expenditure; and

 

          WHEREAS, the State Department of Environmental Protection, has approved a grant to the Borough of Barnegat Light under the Clean Communities Program in the amount of $4,000.00 which has been received; and

 

          WHEREAS, it is the desire of the Borough of Barnegat Light to amend the 2005 municipal budget to provide for the insertion of this grant as a source of revenue and an expenditure appropriation.

 

          NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

          1.   That the Mayor and Borough Council do hereby authorize an amendment to the 2005 Municipal Budget to provide for the insertion of a Chapter 159 (N.J.S.A. 40A:4-87) Special Item of Revenue as follows:

RESOLUTION 05-101

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, REQUESTING APPROVAL OF A DEDICATION BY RIDER IN ACCORDANCE WITH NJSA 40A:4-39 FOR THE REVENUE & EXPENSES OF LAND USE DEVELOPER ESCROWS & FEES.

 

 

     WHEREAS, the Borough of Barnegat Light has various revenues and expenses from planning board and zoning board of adjustment applicants seeking approval of development applications, according to the fee schedule of the Borough Code; and

 

     WHEREAS, NJSA 40:55D-53.1 et seq., provides for the payment of a municipality’s professional fees and costs from deposited land use developer escrows and fees; and

 

     WHEREAS, NJSA 40A:4-39 permits a municipality to include in is annual budget a Dedication By Rider, subject to the prior written consent of the Director of the State Division of Local Government Services; and

 

     WHEREAS, said Dedication By Rider may be created for dedicated revenues anticipated during the fiscal year from any dog tax, dog license, revenues collected for school transportation, solid fuel license, sinking fund for term bonds, bequest, escheat, federal grant, motor vehicle fine dedicated to road repairs, relocation costs deposited into a revolving relocation assistance fund, fees collected in connection with recreation programs, receipts from franchise assessments, refund payments from a joint insurance fund, and, subject to the prior written consent of the director, other items of like character when the revenue is not subject to reasonably accurate estimate in advance; and

 

     WHEREAS, said land use developer escrow and fee revenues and expenditures are not subject to reasonably accurate estimate in advance; and

 

     WHEREAS, it is the desire of the Borough of Barnegat Light to create, by Dedication By Rider, a specific dedicated fund for the revenues and expenditures of land use developer escrows and fees.

 

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

1.   That the Mayor and Borough Council do hereby authorize a Dedication By Rider as follows:

    

     The dedicated revenues anticipated during the year 2005 from land use developer escrows and fees are hereby anticipated as revenue and are hereby appropriated for the purposes to which said revenue is dedicated by statute or other legal requirement.”

 

Said dedicated revenues included in this resolution shall be available for expenditure by the Borough of Barnegat Light as and when received in cash during the fiscal year

 

2.  That this Dedication By Rider is subject to the prior written approval of the Director of the Division of Local Government Services.

 

3.   That certified copies of this resolution shall be forwarded to the State Division of Local Government Services, the Borough Auditor and the Borough Treasurer.

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

AMENDING INTERLOCAL SERVICES AGREEMENT

FOR CONSTRUCTION CODE SERVICES

 

 

 

     WHEREAS, the Borough of Barnegat Light entered into an Interlocal Services Agreement with the Boroughs of Beach Haven (Lead Agency), Surf City and Harvey Cedars for the provision of construction Code Services; and

 

 

     WHEREAS,  certain amendments to Schedule C need to be made to this agreement.

         

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey that the attached Schedule C is hereby approved, effective April 1, 2005  

    

     BE IT FURTHER RESOLVED that copies of this Resolution with the Schedule referred to above shall be sent to the boroughs of Surf City, Harvey Cedars and Beach Haven.

RESOLUTION 05-103

 

          RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE EXECUTION OF A CHANGE ORDER TO THE CONTRACT WITH Beachwood Builders Inc.FOR ADDITIONAL ALIGNMENT AND TIE-IN CONSTRUCTION FOR THE MUNICIPAL BULKHEAD RECONSTRUCTION PROJECT.

 

 

          WHEREAS, a contract was previously awarded to Beachwood Builders Inc., for the Municipal Bulkhead Reconstruction Project; and

 

          WHEREAS, the original contract for said work was in the amount of $  279,004.00; and

 

          WHEREAS, the Mayor and Borough Council wish to authorize a change order to provide for additional alignment and tie-in construction, which will result in an increase in the contract price in the amount of $ 34,975.57; and

 

          WHEREAS, the change order has been recommended by the Borough Engineer and agreed to by the contractor; and

 

          WHEREAS, this change order and all other change orders amount to a total less than 20% of the original contract awarded to Beachwood Builders Inc.

 

          NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

          1.   That the Mayor and Borough Council of the Borough of Barnegat Light do hereby authorize the execution of Change Order Number 1 to the contract with Beachwood Builders Inc., for the municipal bulkhead reconstruction project, to provide for an increase of the contract price from $279,004.00 to $ 313,979.57, an increase of $ 34,975.57 in the contract price, consisting of additional alignment and tie-in construction. A copy of said Change Order No.1 is attached hereto & is incorporated herein by reference.

 

          2.  That the Mayor and Borough Clerk are hereby authorized to execute Change Order Number 1 to the contract with Beachwood Builders Inc., in accordance with the provisions of this resolution.

 

          3.  That a Certificate of Availability of Funds, executed by the Chief Financial Officer is annexed hereto.  The following line item appropriations or ordinance which constitute the availability of funds for this contract:

 

         Barnegat Light Bond Ordinance No. 2003-009

 

 

          4.   That a certified copy of this resolution shall be forwarded to the Chief Financial Officer, the Borough Engineer and Beachwood Builders Inc.

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

EMPLOYING CONSTRUCTION CONTROL CLERK

 

 

     WHEREAS, it is the desire of the Mayor and Council of the Borough of Barnegat Light to employ a Construction Control Clerk; and

 

     WHEREAS, the position was duly advertised.

 

     NOW, THEREFORE BE IT RESOLVED AS FOLLOWS:

 

1.  Laurie Bunyan is hired as Construction Control Clerk effective May 17, 2005.
