MAYOR & COUNCIL MEETING   BARNEGAT LIGHT MARCH 16, 2005

 

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 3, 2005 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 3, 2005, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 3, 2005.

The Mayor began by mentioning the “Riley” dirt pile on Bayview Avenue.  The Mayor did speak with Jim Potts about not dumping there, however he had not spoken to the owner of the property.  George Warr said he will speak to the owner.  Next up was the Traffic Lights being turned on for the summer.  Mrs. Reynolds did not think this was a good idea.  She felt traffic would go on Bayview Avenue to avoid the lights and that would make for a problem at the 25th  Street Bay bathing beach.  She also asked if the Fire and First Aid were aware of this.  Jim Morrison said at a previous meeting he had spoken to both Keith Anderson and Bob Van Meter regarding same.  Lt. Paul Verbe of the Long Beach Police said at a meeting with the Mayor last week that he (Paul Verbe) would personally speak to both parties.  Jim Morrison also said before that if the 10th Street light becomes a problem for the FAS or Fire Department we would turn it off.  Both the Chief of Police and Lt. Verbe (who is the traffic safety officer) said we rally need to do this for the people who are trying to cross the street.  It is mainly for pedestrian safety. On a motion by Reynolds, seconded by Bossi and carried by all, there was a 5 minute recess before the regular meeting.

MUNICIPAL BUDGET HEARING:

 

Auditor, Bill Antonides was here to discuss the budget.  He said we would have had a 1.3 cent tax increase, but due to an action taken later this evening we will have a 1 cent increase.  This is a direct result of Certification of State Aide figures.  This will be incorporated into an amendment later this evening.  Reynolds moved to open the budget hearing, seconded by Spark and carried by all.  There were no public comments.  Reynolds moved to closed, seconded by Howard and carried by all.  There will be no adoption of the budget tonight. Bill went on to say what the amendment does.  It certifies the state aid numbers.  For the second year in a row there is Homeland Security Aid that is factored into the budget.  That is $25,000.  In addition the resolution makes available the use by deferred school tax to cover an anticipated short fall in the water sewer utility.  He than explained why there is a short fall in the Water Sewer.  We had a $60,000 emergency last year.  We also have been paying down debt aggressively.  Lisa had already negotiated with the bank for payment.  That in essence is the amending resolution!  There will be a public hearing on the amendment at the next meeting.  Bill explained what happens when we exceed the 3 and one half percent cap.  We must go before the Local Finance Board for permission to exceed.  We present our argument, there is discussion to explain.  Dave Bossi wanted to know if the rate increase would put us back on a more even keel and he was told not this year.  George Warr asked when the bonds come up and was told in March.  Dave wanted to know what the sale of water had to do with money coming from the current fund (our taxpayers) to put money into water sewer which is our residents and the water we sell to Long Beach Township.  It was explained that they pay their fair share.  Lisa recommended we begin budget workshops in October – in fact Bill said the Division of Local Government recommends same.  We are looking at May for adoption of the 2005 budget.  Bill said hundreds of towns have not introduced their budgets yet.

ORDINANCE 2005-011

 

 

 

CALENDAR YEAR 2005

 

ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS

AND TO ESTABLISH A CAP BANK

(N.J.S.A. 40A:4-45.14)

 

     WHEREAS, the Local Government Cap Law, N.J.S. 40a:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,

 

     WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,

 

     WHEREAS, the governing body of the Borough of Barnegat Light in the County of Ocean finds it advisable and necessary to increase its CY 2005 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens, and,

      

     WHEREAS, the governing body hereby determines that a one percent increase in the budget for said year, amounting to $14,647.27 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and

 

     WHEREAS, the governing body hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

 

     NOW, THEREFORE, BE IT ORDAINED by the governing body of the Borough of Barnegat Light in the County of Ocean, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2005 budget year, the final appropriations of the Borough of Barnegat Light shall, in accordance with this ordinance and N.J.S.A. 40A:4-45.14 be increased by one percent amounting to $14,647.27, and that the CY 2005 municipal budget for the Borough of Barnegat Light be approved and adopted in accordance with this ordinance; and,

 

     BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

 

     BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and

 

     BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.

RESOLUTION NO. 05-76____

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

INCREASING DEFERRED REGIONAL SCHOOL TAX

 

     WHEREAS, the State of New Jersey, Division of Local Government Services, requires an annual resolution by Municipalities that raise school taxes on a school year basis, and wish to defer a portion of that levy at the beginning and end of a calendar year, and

 

     WHEREAS, a Municipality that raises school taxes on a school year basis may defer up to the lesser of (1) 50% of the school levy, or (2) the unpaid balance of the school tax on December 31st less any unpaid requisitions on that date; and

 

     WHEREAS, based upon the above procedure, the allowable amount of regional school tax that may be deferred on December 31, 2004 is $697,241.67 which is an increase from the $500,258.54 allowed to be deferred on December 31, 2003.  Said increase being the result of an increase in the 2004-2005 levy over the 2003-2004 levy; and

 

     NOW, THEREFORE, BE IT RESOLVED that as of December 31, 2004, the governing body desires to increase the deferred regional school tax by $25,000.00 to $346,245.00.

 

     AND, BE IT FURTHER RESOLVED that a certified copy of this Resolution is to be forwarded to the Director of the Division of Local Government Services, William E. Antonides, Auditor, and Elizabeth Jones, Chief Financial Officer.

RESOLUTION 2005-082 

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY

MAKING APPLICATION TO THE LOCAL FINANCE BOARD

PURSUANT TO N.J.S.A.40a4-45.3ee

 

 

     WHEREAS, the Borough of Barnegat Light desires to make application to the Local Finance Board for its review and/or approval of a proposed Cap Waiver authorizing the Borough to exceed the Cap by $84,000.

 

     WHEREAS, the governing body of the Borough of Barnegat Light believes:

 

(a)                                                                                                         it is in the public interest to accomplish such purpose:

(b)                                                                                                         said purpose is for the health, wealth, convenience or betterment of the inhabitants of the local unit;

(c)                                                                                                         the amounts to be expended for said purpose is not unreasonable or exorbitant;

(d)                                                                                                         the proposal is an efficient and feasible means of providing services for the needs of the inhabitants of the local unit or units and will not create an undue financial burden to be placed upon the local unit or units;

 

     NOW, THEREFORE, BE IT RESOLVED by the governing body of the Borough of Barnegat Light:

 

     Section 1: The application to the Local Finance Board is hereby approved, and the Borough Auditor and financial advisor, along with other representatives of the Borough of Barnegat Light, are hereby authorized to prepare such application and to represent the Borough in matters pertaining thereto:

 

     Section 2: The Chief Financial Officer of the Borough of Barnegat Light is hereby directed to prepare and file a copy of the proposed Cap Waiver with the Local Finance Board as part of such application.

 

     Section 3: The Local Finance Board is hereby respectfully requested to consider such application and to record its findings, recommendations and/or approvals as provided by the applicable New Jersey statute.

COMMITTEE REPORTS:

 

WATER/SEWER:  COUNCILMAN SPARK asked that the water sewer report be made a part of the minutes.  He said he met with Commissioner Bayard from Long Beach Township and explained that the water rates are going up so that he would not be surprised by the bill.  George Warr asked about the master meters.  Mike said that the Township had $20,000 in their budget to replace the High Bar one and also the Loveladies one.  We do not have a problem with the Loveladies meter.   

 

PUBLIC SAFETY:  COUNCILMAN MORRISON was absent.  The Mayor asked that the Police Report for February and March be a part of the minutes.

 

DOCKS AND HARBORS:  COUNCILMAN BOSSI said the bulkhead is finished.  Art had his men rebuild two floating docks that had disappeared.  The cost was around $800.00. WE have joined with a State contract for 4th Street. Bulkhead at the condos is 1/3 done. Don’t drive to the end of 5th Street, it is very undermined. Next he mentioned a HAM radio operator’s course being given by the County EOC.  April 30th and May 1 are the dates.  The cost is $24.00 for the book and $14.00 for the test itself.  The Barnegat Light EOC will pick up the tab.  This is a very meaningful program!  The Mayor asked what HAM meant and also asked if the Party Boats radio operators were not HAMS – they are ship to shore radios.  HAM is an amateur radio operator.  Right now Cathy and Harry Howard and Jack McCarty are the only HAMS at the EOC. 

 

BEACHES AND PARKS:  COUNCILWOMAN REYNOLDS said that Art is putting a few trashcans on the beach.  Seals have been on the beach.  If you see any  that appear to be in trouble call the Marine Mammal Stranding Center and do not do near them – they bite!  

 

PUBLIC WORKS:  COUNCILMAN HOWARD asked that Art’s Report be made a part of the minutes.

 

FINANCE:  COUNCILMAN WARR said the Lisa and Bill handled everything.  Our tax rate will increase by 1 penny when we’re done.

 

OPEN PUBLIC SESSION:  On a motion by Reynolds, seconded by Howard and carried by all, the public session was opened. Shirley Alnutt said she wants the traffic lights on for the summer.  Mary Jane Preiser said the traffic lights are a good idea – why not try it!  Dottie Reynolds said she just can’t go along with putting the traffic lights on.  She is concerned with safety at the Bay Beach.  You have cars backing out she said. Mary Jane Preiser said the Lt. Paul Verbe is a trained Safety Officer and she feels he knows what he is talking about.  Marilyn Wasilewski said the Southern Regional School Board reduced the budget by 3.8 million dollars.  Barnegat Light’s share will decrease by $326,000. It hasn’t been approved by the Superintendent yet. Barnegat is withdrawing students so we are not getting any income from them.  She than mentioned that 6 wrestlers from Southern went to the finals and one of them was our own Tyler Larson.  He did very well!  He beat a kid whose record was 31 to 1.  There were 32,000 people there, it was great.  Pete Malacrea said that wrestling is one hell of a sport!  Harry Howard asked what kind of cuts were done.  Marilyn said she can’t say until approved by the County Superintendent.  People are going to be unhappy – parents are going to be unhappy.  Had to let go all the teachers who were hired last year.  Basic school has only decreased by 125.  Next month she will tell us more.  On a  motion by Warr, seconded by Bossi and carried by all the public portion was closed.

RESOLUTION 05-072

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, REQUESTING APPROVAL OF A DEDICATION BY RIDER IN ACCORDANCE WITH NJSA 40A:4-39 FOR VARIOUS PARKING OFFENSE REVENUES & EXPENSES.

 

 

     WHEREAS, the Borough of Barnegat Light has various revenues generated from Parking Offenses, and various expenses related to the same; and

 

     WHEREAS, NJSA 40A:4-39 permits a municipality to include in is annual budget a Dedication By Rider, subject to the prior written consent of the Director of the State Division of Local Government Services; and

 

     WHEREAS, said Dedication By Rider may be created for dedicated revenues anticipated during the fiscal year from any dog tax, dog license, revenues collected for school transportation, solid fuel license, sinking fund for term bonds, bequest, escheat, federal grant, motor vehicle fines dedicated to road repairs, relocation costs deposited into a revolving relocation assistance fund, fees collected in connection with recreation programs, receipts from franchise assessments, refund payments from a joint insurance fund, and, subject to the prior written consent of the director, other items of like character when the revenue is not subject to reasonably accurate estimate in advance; and

 

     WHEREAS, said Parking Offense revenues and expenditures are not subject to reasonably accurate estimate in advance; and

 

     WHEREAS, it is the desire of the Borough of Barnegat Light to create, by Dedication By Rider, a specific dedicated fund for Parking Offense revenues and expenditures.

 

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

1.   That the Mayor and Borough Council do hereby authorize a Dedication By Rider as follows:

    

     The dedicated revenues anticipated during the year 2005 from the Parking Offense Adjudication Act are hereby anticipated as revenue and are hereby appropriated for the purposes to which said revenue is dedicated by statute or other legal requirement.”

 

Said dedicated revenues included in this resolution shall be available for expenditure by the Borough of Barnegat Light as and when received in cash during the fiscal year

 

2.  That this Dedication By Rider is subject to the prior written approval of the Director of the Division of Local Government Services.

 

3.   That certified copies of this resolution shall be forwarded to the State Division of Local Government Services, the Borough Auditor and the Borough Treasurer.

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

AUTHORIZING THE PAYMENT OF MUNICIPAL BILLS

IN THE AMOUNT OF $ 2,319,871.35

 

     WHEREAS, the Finance Committee of the Borough of Barnegat Light has examined the vouchers presented for payment,

    

 

     NOW, THEREFORE, BE IT RESOLVED, that the approved vouchers amounting to $2,319,871.35 authorized to be paid upon verification of the Treasurer that there is sufficient money in the appropriated accounts, subject to adequate signatures and funding.

RESOLUTION 05-74

 

          A RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, PROVIDING FOR TEMPORARY BUDGET APPROPRIATIONS ACCORDING TO N.J.S.A. 40A:4-19.1.

 

  WHEREAS, the Mayor and Council of the Borough of Barnegat Light desires to amend the Temporary Budget;

 

  WHEREAS, such amendments are permitted by law;

 

NOW, THEREFORE, BE IT RESOLVED, the Mayor and Council of the Borough of Barnegat Light make the following changes to the 2005 Temporary Budget.
