MAYOR AND COUNCIL MEETING    BARNEGAT LIGHT  OCTOBER 17, 2007

 

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 2, 2007 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 2, 2007, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 2, 2007.

 ALSO PRESENT: MAYOR LARSON,  TERRY F. BRADY, BOROUGH         ATTORNEY AND GAIL WETMORE  

 

The Mayor asked if anyone had anything for caucus.  Frank Mikuletzky discussed the letter from Lee Riley asking to transfer his slip along with his boat to his niece.  We also discussed water meters and what the town is going to do to comply with same.   On a motion by Reynolds, seconded by Morrison and carried by all, there was a 10 minute break.      

 

THE MEETING of the Mayor and Council was called to order by Mayor Kirk Larson, at 8:00am at the Borough Hall, on West 10th Street. The Mayor stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by transmitting notice of same to the Beach Haven Times and the Atlantic City Press on January 2, 2007 and by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 2, 2007 Said news papers were designated by Mayor and Council on January 2, 2007, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 2, 2007.

COMMITTEE REPORTS:

 

FINANCE:  COUNCILMAN WARR said we will be having receipt of audit this evening.  There are a few problems and they will be corrected.

 

BEACHES AND PARKS:  COUNCILWOMAN REYNOLDS read from a report from the Chief Financial Officer that included all salary figures associated with the beaches.  She said the dog park fencing should be here soon.  She also mentioned that 25th Street does not have a walk way and that people have complained to her.  She realized it has something to do with a handicap lawsuit against the Borough.

 

DOCKS AND HARBORS: COUNCILMAN MIKULETZKY asked that the report from the CFO be made a part of the minutes.

 

PUBLIC SAFETY:  COUNCILMAN MORRISON asked that the Court Report for September be made a part of the minutes.

 

WATER/SEWER: COUNCILMAN SPARK asked that the Water/Sewer Report be made a part of the minutes.  There was discussion regarding water meters in town.

 

PUBLIC WORKS:  COUNCILMAN HOWARD was absent and the Mayor asked that the public works report be made a part of the minutes.

 

0PEN PUBLIC SESSION:  On a motion by Warr, seconded by Morrison and carried by all, the public session was opened.  Tom Day questioned the sale of beach badges and why it did not cover expenses.  He was told it never does.  Tom Stiles asked about the status of the Snowflakes.  Lee Riley explained his request to transfer his boat slip and boat to his niece.  On a motion by Warr, seconded by Morrison and  carried by all the request was granted to transfer to Patti Clark of 2901 Central Avenue, Barnegat Light.  On a motion by Morrison, seconded by Howard and carried by all the meeting was once again closed.

RESOLUTION 2007-107

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

IN SUPPORT OF RE-CLAM THE BAY, INC. AND

OBSERVING OCTOBER AS SEAFOOD MONTH

 

     WHEREAS, the health of Barnegat Bay, its natural resources and watersheds are critically important to the health, economy and quality of life to  the residents and visitors to Ocean County and particularly to Barnegat Light as a directly impacted municipality bordering the bay and the rest of the State of New Jersey; and

 

     WHEREAS, the shellfish populations of Barnegat Bay have significantly been reduced over the past 30 years from numerous insults to the bay and efforts to increase the size of the shellfish population in Barnegat Bay are believed to be helpful in improving the environmental quality of the bay waters and the health of the overall ecosystem; and

 

     WHEREAS, including volunteers in the effort to add more shellfish to Barnegat Bay will increase awareness of the value of a healthy bay, the importance of individual actions and water quality in the entire Barnegat Bay watershed and the importance of the bay environment to the overall quality of life in Ocean County.

 

     NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of Barnegat Light, that we commend and support the efforts of the Barnegat Bay Restoration Program which is coordinated by the Rutgers Cooperative Extension of Ocean County, the New Jersey Department of Environmental Protection, Division of Fish and Wildlife Bureau of Shellfisheries and assisted by the ReClam the Bay, Inc. program.

 

     BE IT FURTHER RESOLVED, that since clams and oysters are part of the seafood industry of the State of New Jersey, that we also join in observing October as Seafood Month.

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

AUTHORIZING THE PAYMENT OF MUNICIPAL BILLS

IN THE AMOUNT OF $1,322,453.95

 

 

          WHEREAS, the Finance Committee of the Borough of Barnegat Light has examined the vouchers presented for payment,

 

          NOW, THEREFORE, BE IT RESOLVED, that the approved vouchers amounting to $1,322,453.95 be authorized to be paid upon verification of the Treasurer that there is sufficient money in the appropriated accounts, subject to adequate signatures and funding.

RESOLUTION 07-109

 

          RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING AN AMENDMENT TO THE 2007 BUDGET TO ALLOW FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE AND APPROPRIATION PURSUANT TO N.J.S.A. 40A:4-87 (CHAPTER 159) FOR THE STORMWATER IMPLEMENTATION GRANT.

 

 

          WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any local unit when such item shall have been made available by any public or private funding source and the amount thereof shall not have been determined at the time of the adoption of the budget; and

 

          WHEREAS, N.J.S.A. 40A:4-87 further provides that the Director may approve the insertion of an appropriation item of an amount equal to any such special item of revenue making such item of revenue available for expenditure; and

 

          WHEREAS, the Ocean County College has approved a grant to the Borough of Barnegat Light under the Barnegat Bay National Estuary Program for Stormwater Implementation in the amount of $1,000.00, and

 

          WHEREAS, it is the desire of the Borough of Barnegat Light to amend the 2007 municipal budget to provide for the insertion of this grant as a source of revenue and an expenditure appropriation.

 

          NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

          1.   That the Mayor and Borough Council do hereby authorize an amendment to the 2007 Municipal Budget to provide for the insertion of a Chapter 159 (N.J.S.A. 40A:4-87) Special Item of Revenue as follows:

                        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AWARDING A CONTRACT FOR THE 12th STREET RECONSTRUCTION PROJECT.

 

 

            WHEREAS, the Borough of Barnegat Light duly advertised for the receipt of bids for the 12th Street Reconstruction Project; and

 

            WHEREAS, at the time, place and date set for the receipt of bids, five (5) bids were received by the Borough as follows:

 

                        Earle Asphalt Company                        $  89,513.13

                        A.E.Stone                                            $  no bid

                        C.J.Hesse Inc.                                      $  99,493.08

                        Mathis Construction                              $  97,542.50

                        Haskell Site Work                                $ 101,755.00

                        B&B Construction                                $ 159,155.00

                                                                       

            WHEREAS, said bids were taken under advisement and have been reviewed by the Borough Engineer and it has been determined that Earle Asphalt Company, submitted the lowest responsible bid in accordance with the bid specifications, said bid being in the amount of $89,513.13; and

 

            WHEREAS, it is the desire of the Mayor and Borough Council of the Borough of Barnegat Light to award a contract for the 12th Street Reconstruction Project to Earle Asphalt Company, the lowest bidder.

 

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

            1.         That the Mayor & Borough Council of the Borough of Barnegat Light do hereby award the contract for the 12th Street Reconstruction Project to Earle Asphalt Company, at the price of $89,513.13.

 

            2.         That the Mayor and Borough Clerk are hereby authorized to execute an agreement with Earle Asphalt Company, for said project, said agreement to be in conformance with bid specifications and bid submitted by Earle Asphalt Company.

 

            3.         That a certificate of availability of funds executed by the Chief Financial Officer is annexed hereto.  The following line item appropriations or ordinances constitute the availability of funds for this contract:

The Clerk read the above by title and number and the Mayor  announced it is time to consider same for passage on second reading according to law and ask for a motion to open public hearing.  There were no comments so on a motion by Warr, seconded by Morrison and carried by all the public hearing was closed. Morrison moved to adopt,  seconded by Spark..

The Clerk read the above by title and number and the Mayor announced it is time to consider same for passage on second reading according to law and asked for a motion to open public hearing.   Reynolds so moved, seconded by Mikuletzky and carried by all.  There was no comment and Warr moved to close, seconded by Morrison.  Morrison moved to adopt, seconded by Spark.
