MAYOR & COUNCIL MEETING   BARNEGAT LIGHT JULY 20, 2005

 

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 3, 2005 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 3, 2005, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 3, 2005.

The Mayor said a lot of people are here tonight – a cross section of the town.  He wanted to discuss the trash and recycling situation in town.  There is a lot of cardboard lying around and we have a problem with brush.  Harry Howard said he has already spoken to Art Ballinger about this and Art is studying the cardboard problem.  The council also discussed whether or not to change people when we have to pick up brush when they have it out and there is no pickup.  In the fall we will have to do an ordinance if we are going to charge them.  Harry Howard said he and his committee will look into how to handle it.  Dave Bossi enlightened everyone on the progress of the Coast Guard Cottage.  Monday, he met with the architect and our engineer.  There will be no public occupancy of the third floor or the basement.  That way we will only have to build the stair tower to the second floor.   We will be putting a new roof on the building and are going out to bid on the lead paint removal. Dottie Reynolds asked if we were going to discuss the  Feasibility Study and the mayor said lets wait for the regular meeting.  On a motion by Bossi, seconded by Spark and carried by all there was a 15” recess.  The mayor reminded everyone to save their seats.

At this point in the meeting, Terry F. Brady read from the Notice to Bidders for the auction.  Verizon bid $30,000 per year to have antennae on the Water Tank at 10th Street.  Terry explained to the audience what this is for and there were no other bids for same.

 

RESOLUTION 05-123

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE LEASING OF CERTAIN MUNICIPAL PROPERTY.

 

            WHEREAS, the Borough of Barnegat Light owns certain property as set forth on Schedule A attached hereto and made a part hereof; and

 

            WHEREAS, the Mayor and Borough Council have determined that this property is not needed for exclusive public use; and

 

            WHEREAS, N.J.S.A. 40A:12-24 provides that a municipality may lease any lands or buildings or portions thereof not presently needed for public use to the person who will pay the highest rent therefor; and

 

            WHEREAS, the governing body has set a certain price as being the minimum acceptable bid for the leasing of said property, as set forth on Schedule A attached hereto and made a part hereof; and

 

            WHEREAS, it is the desire of the Mayor and Borough Council of the Borough of Barnegat Light to accept the highest bid submitted for the leasing of the aforementioned property.

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

            1.         That the Borough of Barnegat Light does hereby authorize the leasing of the municipal property set forth in the attached Schedule A to the highest bidder, Verizon Wireless, for the price of $$30,000 per year, in accordance with all other terms of the offered Lease Agreement.

 

            2.         That the Mayor and Borough Clerk are hereby authorized to execute any and all documents necessary to lease said property in accordance with the terms of the published Notice to Bidders.

COMMITTEE REPORTS:

 

FINANCE:  GEORGE WARR met with Brian Logan, who is conducting our audit and all is going well. 

 

BEACHES AND PARKS:  DOROTHY REYNOLDS said that beach badge fees are up this month, tennis is down.  New beach wheels have been approved for from the Community Development Block Grant.  She went over highlights in the lifeguard report.  She also gave the plover report.

 

 

WATER AND SEWER:  MICHAEL SPARK asked that the water sewer report be made a part of the minutes.

 

DOCKS AND HARBORS:  DAVE BOSSI said Docks are down 20%.  He thanked Woodie Smedley for all his work with emergency management because Woodie is moving to Pennsylvania.  We will all miss him.

 

PUBLIC SAFETY:  JIM MORRISON asked that the Police and Court Reports be made a part of the minutes.  He said he has had good reports on the red lights.  Dottie Reynolds said there is more traffic on Bayview Avenue due to same.  We will be having the bike cops soon.  The Mayor mentioned the Bike Safety Day on August 14th.  There will be prizes and fun for all children.   

 

PUBLIC WORKS:  HARRY HOWARD read from the public works report and said that Art has 5 year round workers including himself and 3 summer employees.  Harry mentioned the mess that greeted the men on Monday morning in the sewer lift station and what a good job they did.

 

OPEN PUBLIC SESSION: 

 

Warr moved to open the regular public session seconded by Howard and carried by all.  Sarah Lambert was the first to speak.  She said the BLTPA held a general meeting on July 9th. The focus of the meeting was the Feasibility Study of SRHS.  There was a 1 and ½ hour discussion.  At that meeting the BLTPA said they should present a resolution to the Borough Council asking them to revisit the issue. She read the resolution at this point.  She said they sent out 1258 letters with a survey postcard.  About 40% replied and of that number 92% said yes to do the study.   Of that percent 95% have a 2nd home and 88% live here permanently.  She felt that the members of the BLTPA were very disciplined and very self policed.  Whenever the topic moved away from the Feasibility Study they brought it back themselves.  Councilman Morrison asked what about the 60% who didn’t respond – Sarah said she is still counting and receiving replies. The Mayor said to stop this bickering back and fourth – it was not even an accurate survey as far as he was concerned. The Mayor said he would like Sarah, as President of the BLTPA, to say if she had ever spoken to Vito Gagliardi and she replied no, but she had read what is included.  The Mayor asked here what does the Feasibility Study do.  Sarah said there are two ways …… the Mayor said he had the answer right in front of him and read from a paper in his hand. Basically it said to be effective, the proposal must be adopted by a majority of the legal votes cast within the withdrawing constituent district or municipality and in addition a majority of the combined legal votes cast within remainder of the district.  It means everybody – Stafford, Long Beach Island and everybody would have to cast a vote to do it.  So if it looses in the referendum, State Statute says that’s over.  Sarah Lambert said a Feasibility Study can tell you something that you don’t know.  The Mayor said the Feasibility Study has to be done to put it on the referendum.  Sarah Lambert said that was correct.  The Mayor asked her how she planned on winning.  The financial part of the study was discussed next by the Mayor.  He said the original price was $36,000 between 6 towns. We were going to put in $3000.  Dottie Reynolds said it could still be $3000 or it could be $2500.  The Mayor said to Sarah that she riles up the troops – that’s great, because the BLTPA is a great organization.  But to fight something that’s not going to go anywhere is fruitless.  Sarah said to the Mayor to say you don’t want information – The Mayor said I say the BLTPA ought to take this to Trenton – not to this office.  Councilman Warr said he didn’t think there’s anybody in this room that thinks this situation is equitable – we all agree,  if  you’re talking on a per student basis. If you put this effort to your state legislature – you’re fighting in the wrong place – it has to be done in Trenton – it has to come from the state legislature.  It can’t come from here.  Councilwoman Reynolds said she was at the meeting with Vito and her understanding is that there’s a process.   First the Feasibility Study, then the referendum and if that fails, legal action.  She said you are never going to get negotiations with Stafford Township if they feel we don’t care.  Mayor Block would have to tell the voters.  Borough Attorney Terry F. Brady said there is no legal precedent for challenging a negative vote on such a referendum.  The legal precedent was for a yes vote.  North Haledon was in favor of dissolution.  Councilwoman Reynolds asked if it was possible – the vote goes down could it be challenged.  Terry F. Brady said he‘s seen absolutely no legal precedent in that situation.  It may be within the realm of possibility – certainly not probability.  Councilman Spark asked Terry to talk of the North Haledon case – of the financial side and why the decision was rendered because of the financial side.  The referendum passed, the judge took it one step further financially.  The Mayor said it was approved by the voters, but there was a racial imbalance.  Marilyn Wasilewski said the North Haledon decision is back in court. Cindy Wood has been a resident of Barnegat Light for 21 years and a teacher at SRHS for 16.  She said she doesn’t want her taxes or any of her money going to a study that is going to hurt children.  That’s what she feels this is all about. At the BLTPA meeting she was insulted that as a teacher she had a man say that her students end up to be nothing – they don’t end up being anything in this town anyway. Over 700 graduated and she has a list of where they are going to college. How the meeting was run to her was a lynch mob.  Sarah began to interject at this point and the Mayor said it’s not going to turn into a BLTPA meeting – not one person in the audience is going to talk to another like they did at that meeting.  Bob Leonard said he read the Mayor’s letter and he said we have been talking for years.  What are we going to do – talk it to death?  We’re paying too much money.  The Mayor said you must go to the state.  Bob said a federal court can change the law.  If it’s more than $3000 (the Feasibility Study) don’t get into it.  Tell us tonight - $3000 you’ll do it – if more you won’t do it. Councilman Warr said the Feasibility Study is to withdraw from the system.  It’s not how may we fund this, how may we get the tax relief.  The Feasibility Study is shall we withdraw or shall we not. Councilwoman Reynolds said the Seaside Park study gives options.  George Warr said not withdraw!  If it were a study on how we can change the funding around – not to withdraw – that’s his objection. Bob Leonard wanted to know what came over the council.  Walter Puhalski asked in any member of council had spoken to Vito personally.  Dave Bossi said he had.  Dave said Vito said we would look stupid if all the other coastal towns were doing it and we didn’t.  (That might not have been his exact words).  Dottie said we can always drop out if we don’t want to go all the way. Ronald Cracas said we would be foolish not to join in.  He is an attorney and went over all the steps for doing a Feasibility Study.  He was very much in favor of doing it.  Linda Larson said she is now a minority in Barnegat Light.  You are short changing the children.  The Feasibility Study may pull children out of Southern.  Kristin Patterson and her husband are both Southern graduates. He is a dentist and she is a nurse. Her children are 4 and 6 years old and they better be going to Southern.  They deserve the education their parents got. Sal Cascio said he taught Physical Education for 42 years.  Southern Regional is an excellent school – top notch.  All we want is a feasibility study.  Millionaires – yes if we are it is because we own land.  One dollar, 2 dollars or 5 dollars is not going to break him.  Mayor said to Sal you are more or less saying lets go three steps.  Sal said yes, one at a time.  Mayor Larson said we are either going or not going.  We hashed this over all winter long and finally came to the conclusion in March we’re not going all the way – so if not – forget about it. Dottie said is saving $3000 worth tearing the town apart and having people angry with each other – we could do the study – The Mayor said to Dottie why don’t you just tear the town apart a little bit more.  Dottie said no one wants to hurt children.  Joe Hogan said he got his tax bill and his taxes are down.  County and Library are more than the regional taxes – where is your outrage?  You are picking on the school.  He told the council they are making the right decision.  He said the $3000 makes a difference.  When they do equalize that school aid – whoop de doo – your taxes are going to double.  We better keep our mouths shut and let the mayors get together.  Work within the system. Lacey Brindley is a Southern Regional graduate.  She owned a home in West Creek that was accessed at $100,000 and paid $2700 in taxes.  Here home here in Barnegat Light is worth around $700,000 and she pays $5500 in taxes.  If that same house were in West Creek she would be paying $18,900 in taxes.  She feels she has reasonable taxes in a beautiful town. Eric Stokes, resident and leader of Boy Scout Troop 18 said kids thrive on this island. He said he lives here and for most of the audience this is a cause to raise the flag because it is your vacation home.  Please don’t take it out on our children.  Marion Larson who said she is the mother of the mayor said she has a sister in Ocean Acres and another in Medford Lakes.  They both have homes as nice as hers and they pay about the same amount of taxes.  It may be distributed differently, but it is about the same.  Our Borough taxes are so low.  You can’t go by people (per student); I can’t believe any of you who are protesting this pay less taxes where you come from otherwise.  The Mayor said boy, don’t get my mom mad. Bonnie Eskra said do it – she doesn’t see any harm.  She doesn’t feel this necessarily leads to steps 2 and 3.  You have to see what your options are.  Mayor Larson said we have been trying to work with the school boards.  He’s been working with Jon Oldam of Harvey Cedars to work with the school boards – maybe even to do our own.  Have the school board do a Feasibility Study – to pressure them – this thing we have to do it today – why always today.  People in West Cape May are doing it, Cape May Point, Seaside Park – this guy (Vito) is going up and down the coast preaching to everybody he’s going to save them a million.  Do we have to do it this week?  Let’s see what the guy is doing and I think a resolution maybe working with the mayors – a resolution from the towns to the school board to do their own Feasibility Study. This guy who is selling the snake oil – I don’t know what he’s selling – let’s see what he’s selling. Mr. Cracas said that was a little unfair.  He happens to know Vito and his is an outstanding council in the state and he said he is sure he is not selling snake oil and soliciting business.  John Michael said he understands there are a lot of opinions.  The Taxpayers have asked you to reconsider the issue.  Unlikely to happen tonight.  No one wants to hurt the children.  Put it on a resolution and let the voters decide if you don’t want to.  Put on Ballot – for $3000. The Mayor said to him that he had said at the Taxpayers meeting that he was pretty good at math.  The study was $36,000 – Let the voters decide said Mr. Michal – the Mayor said I listened to enough of you last week. Kevin Michal said he might not know much about government but a very respected lawyer and certain councilman and woman have been sort of short changed.  He said he thought everyone deserves the same amount of respect.  He didn’t have an opinion one way or another.  Put it on a resolution and let the town speak for itself.  Cap it at $3000. You’re put on this council to represent the town after all.  The Mayor asked Kevin what we would be voting for.  You vote on the Feasibility Study.  Mayor Larson said you vote on disbanding Southern Regional.  Terry F. Brady said he had documentation from Beach Haven that says the study is on the dissolution of the school district.  He doesn’t take an opinion for or against.  Be perfectly clear not alternate finance – but to dissolve.  Dottie Reynolds disagreed with Terry.  He said this came from Beach Haven.  Dottie thinks they tailor them according to the district.  She said once again we are elected to represent the people.  92 or 4 percent of the people want the study. Jim Morrison said of the people who responded.  Dottie said the other 60% are not that interested.  Councilman Spark said lets find out from Beach Haven.  Let’s get more information.  The Mayor said where have you been – we have been doing that.  Walter Puhalski wanted to speak once more.  He said he and his wife have been coming here since the 80’s and bought a home 5 years ago.  He would never hurt children or dissolve it.  He said they belong to the BLTPA and get info from Sarah Lambert and from their newsletter.  Not once have we ever received anything from council on your opinion or reasoning.  He said he comes here every weekend.  He is from New York.  He said he is busy – his wife said she couldn’t make it – but he did and he is here. He felt we should have meetings on Saturday mornings at 9:30am during the months of May, June, July, August and September so he can come down and get the right info. He said he is here to come to a solution.  We have misinformation – let’s find out, not put it in the garbage.  Mr. Bossi told him he had bad information.  Dave Bossi said no, I said one sided information.  The Mayor asked him how much he paid in school taxes and he said $1200. He pays $4000 in New York.  Do you attend meetings at home the Mayor asked and Mr. Puhalski said absolutely not.  Than why should we have Saturday meetings because you don’t trust us?  Mary Jane Presier asked what he paid at home in taxes and he said $4000.  He than said we accomplished nothing – put vote out to the people.  Research it. Ron Goedel has owned property for 30 years.  Liked it so much he bought another property.  Don’t totally ignore it.  The Mayor said it is tough to own a home here.  Ed Marra said something really peculiar is going on.  Most people don’t think the funding formula is equitable.  Council has said something has to change.  Councilman Howard said it is a Trenton issue the way funding is calculated. Dave Bossi said we are talking about a statewide issue, not necessarily a Southern Regional Issue.  And because he had the floor (Dave) consider the possibility that because less that 10% of the people who own property choose to make use of the school system. Ed Marra said the situation is wrong – we’ve had it for so many years but we’re working on fixing it.  I have a very direct question and that is it. If you believe that the financing formula is fine and the council really doesn’t need to do anything (and a lot of people feel you aren’t doing anything) - the Mayor said I’ve had it, sit down.  I don’t want to hear council doesn’t do anything around here – absolutely outrageous. Darren Stivale wanted to know about Verizon on the Water Tank as he is a close neighbor.  He was assured that Verizon is well aware of what they have to do.  Terry Brady was asked by Mary Jane Preiser what the purpose of the Feasibility Study is and was told dissolution of the school district.  Bette Grimette was concerned about the gully at 21st and 22nd Streets on the beach and said that at high tide she and her husband decided to walk through it and it was almost up to her chin. We will take care of it.  June Goebel wanted to know what is happening with the Coast Guard Cottage.  She was updated by Dave Bossi. Jane Rubella moved here from Bergen County and she loves it here.  She said if the problem is not enough children for the school system we should all have more babies.   On a motion by Warr, seconded by Howard and carried by all the public session was closed.

                        AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE PURCHASE OF A PUBLIC WORKS TRUCK, AND APPROPRIATING $35,000.00 THEREFOR, AND PROVIDING FOR THE ISSUANCE OF $33,000.00 IN GENERAL IMPROVEMENT BONDS OR NOTES OF THE BOROUGH OF BARNEGAT LIGHT TO FINANCE THE SAME.

     WHEREAS, Alliance for a Living Ocean has made application to conduct a raffle in accordance with the Act and Rules and Regulations of the Legalized Games of Chance Control Commission; and

 

     WHEREAS, there is satisfactory proof that the prizes are of the nature and amount allowed by law; and

 

     WHEREAS, in accordance with NJAC 13:47-4.3, fees payable by law, upon findings and determination of the governing body of the Borough of Barnegat Light; and

     WHEREAS, St. Peter’s at the Light Church in Barnegat Light has made application to conduct two raffles in accordance with the Act and Rules and Regulations of the Legalized Games of Chance Control Commission; and

 

     WHEREAS, there is satisfactory proof that the prizes are of the nature and amount allowed by law; and

 

     WHEREAS, in accordance with NJAC 13:47-4.3, fees payable by law, upon findings and determination of the governing body of the Borough of Barnegat Light; and

 

     WHEREAS, the governing body has heretofore waived the payment of any fees payable to the Borough for licenses to conduct raffles on behalf of St. Peter’s at the Light Church.

 

     NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Barnegat Light that upon acceptance of said application to the Legalized Games of Chance Control Commission, the application fee for license payable to the Borough of Barnegat Light be and is hereby waived.

        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

            COUNTY OF OCEAN, STATE OF NEW JERSEY,

     RELEASING DEPOSIT FOR ROAD OPENING PERMIT #03-021W

 

 

     WHEREAS, a Road Opening Permit was issued to Tom Keller for 30 West 11th Street; and

 

     WHEREAS,  inspections were performed by Borough Supt., Art Ballinger, and his recommendation was to refund $850.00 of the $1,000.00 bond because $150.00 is being kept due to excessive inspections.

 

     THEREFORE, BE IT RESOLVED that $ 850.00 be refunded to:                     

                   Tom Keller

                   4 North Long Beach Boulevard

                   Surf City, New Jersey  08008    

 

     BE IT FURTHER RESOLVED that the Borough Treasurer will issue the check.

     WHEREAS, a Road Opening Permit was issued to Tom Keller  for 1102 Bayview Avenue; and

 

     WHEREAS,  inspections were performed by Borough Supt., Art Ballinger, and his recommendation was to refund $850.00 of the $1,000.00 bond because $150.00 is being kept due to excessive inspections.

 

     THEREFORE, BE IT RESOLVED that $ 850.00 be refunded to:

EMPLOYING LIFEGUARD FOR SUMMER ‘05

 

 

     WHEREAS, the Borough of Barnegat Light is in need of lifeguards for summer ’05; and   

    

     WHEREAS,  the following person is employed as noted with the compensation listed below:

 

     NOW, THEREFORE, BE IT RESOLVED that the governing Body of the Borough of Barnegat Light approve the following:

Thank you notes were read from The Ferraro/Morrison Family for use of the beach wheels, also Samantha Hawksworth for same, Evelyn De Laurentis and Family for prompt attention to a Dog Waste sign request on their street.  ALO requested to use 16th Street as a collection point for their Beach Clean Up in Barnegat Light on September 17, 2005.  On a motion by Reynolds, seconded by Bossi and carried by all, permission was granted.  Letter was read from Terry Brady regarding the tax appeal hearings.  He said our Tax Assessor should be commended for a job well done.  Of 9 appeals, the Assessor settled 7 and the other 2 failed to appear.  Thanks to Terry for being there too.
