MAYOR & COUNCIL MEETING   BARNEGAT LIGHT JUNE 15, 2005

 

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 3, 2005 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 3, 2005, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 3, 2005.

The Mayor began by discussing a letter regarding garbage collection at 30th Street.  He said we had discussed this at a previous meeting and the council at that time had said they couldn’t do anything about it. The mayor said people get used to when the trash men come.  Harry Howard asked if when we begin to negotiate a new contract could people offer suggestions, etc.  Gail said they could.  The council discussed this issue for a few minutes and than Dave Bossi asked about the hash marks.  Gail said the county promised they would have them done by 4th of July weekend.  They have been very backed up with a lot of projects on the island.  Dottie Reynolds said the hash marks make it so much easier to cross the street.  People seem to be willing to stop when they see you in the middle.  Even more so than the crosswalks.  Mayor Larson mentioned the lights will be on soon.  Harry Howard said he doesn’t think it will be too productive.  The Mayor said we will have to see how the Chief handles it with the officers.  George Warr entered the meeting at this point.  Dave Bossi mentioned a speed trap set up in town and how we will be getting some revenue.  The Mayor did not think a lot of people would choose to go down Bayview to avoid the light.  Dottie said there are 350 homes in High Bar.  Dave said they will make a right turn on red.  Next there was a discussion on turtles.  If you see one crossing the street make sure that if you do touch it you set it down in the same direction it was going.  George Warr said we should give the letters regarding the trash to waste management.  Since Don Adams was in the audience, Dottie decided to introduce him now.  She mentioned that he is the Captain of the guards and our guards are the Long Beach Island Tournament Winners from 04! Don said there are 36 guards hired this year.  Two are part time – not all hear it the same time so we basically have 31 guards on at any given time.  Nineteen are former LIT’s,  11 are teachers.  Some are married.  We have 3 guards who are EMT’s!  Beaches open Saturday full time.  All the guards are not here yet, but we are officially opening on Saturday the 18th of June.  The mayor asked Don if he knew the new tram driver – he did not, but he taught his son.  Dottie said since Don is here are there any questions from the citizens?  Someone called out about the piping plovers.  ( I believe it was Sarah Lambert.)  We lost two nests.  The guards are aware of the remaining nests and the fact that they have to drive 5 mph at those locations.  Don said what about the fire department?  They have been informed as well.  Don said this is his 31st or 32nd year!  The council took a short break at this time.

At this point in the meeting the Administrator introduced Todd Bettenhausen, representing Verizon Wireless.  He made a presentation regarding Verizon getting on our Water Tower.  He also had Elizabeth Self of Verizon with him. Dave Bossi mentioned the painting of the tank.  George Warr wanted health information regarding the antennas and the Mayor asked about Satellite Phones. On a motion by Bossi, seconded by Morrison and carried by all the meeting was open to the public.  Harry Selover said he did not get good reception with Verizon now and neither did Scott Sharpless.  Sarah Lambert mentioned she does get good reception.  On a motion by Bossi, seconded by Reynolds the public portion was closed.  We will have a public auction at the next meeting of mayor and council.

 

COMMITTEE REPORTS:

 

FINANCE:  GEORGE WARR had noting to report. 

 

BEACHES AND PARKS:  DOROTHY REYNOLDS gave the Beach Badge Report, the Piping Plover Report and said that this is the last day for pre season prices for beach badges.  She mentioned that Captain Don Adams had spoken earlier at the caucus.

 

WATER AND SEWER:  MICHAEL SPARK had no report.

 

DOCKS AND HARBORS:  DAVE BOSSI gave the ramp report and spoke of the bulkhead at 4th Street.

 

PUBLIC SAFETY:  JIM MORRISON asked that the Police and Court Reports be made a part of the minutes.  The Hash Marks will be done by 4th of July weekend.  The lights will be operation on Monday the 22nd.

 

PUBLIC WORKS:  HARRY HOWARD said almost everyone has had their RERP training and that there will be a drill on October 18th.  Art has three summer crew.  Art’s computer is done, so the report is not available this month. 

 

 

 

OPEN PUBLIC SESSION: 

 

Warr moved to open the regular public session seconded by Howard and carried by all.  Sarah Lambert said that the Mayor had given her an assignment to find out the process in which the district dissolves. She did so and said now that has changed, that Long Beach Township and Beach Haven Borough have found another way.  She said the reasons she has heard from the Borough Council does not really explain why council voted the way it voted.  She also said that the correspondence she has received from the Taxpayer members says they are mad as hell and not going to take it anymore.  She said she is inviting the Mayor to come and explain why council voted the way it voted. The meeting is July 9th at the Firehouse she told the Mayor.

 

Scott Sharpless reported on the Environmental Commission.  NJEC was there and they began discussions on various issues regarding the towns involved.  Scott felt it went well.

ORDINANCES:  SECOND READING

 

ORDINANCE 05-12

 

          AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE RECONSTRUCTION OF WEST 17th, 28th & 29th STREETS AND APPURTENANCES THERETO, AND APPROPRIATING $150,000.00 THEREFOR, AND PROVIDING FOR THE ISSUANCE OF $142,500.00 IN GENERAL IMPROVEMENT BONDS OR NOTES OF THE BOROUGH OF BARNEGAT LIGHT TO FINANCE THE SAME.

 

The Clerk read the above and the Mayor announced it is time to consider same for passage on second reading according to law. Reynolds moved to do so, seconded by Bossi and carried by all.  Dr. Zerbe asked about what type of paving are we talking about.  They are DOT streets and it is not just an overlay. Warr moved to close, seconded by Bossi and carried by all.  Bossi moved to adopt, seconded by Spark.

AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING ELECTRICAL UPGRADES AND REPAIRS TO WATER WELL # 4, AND APPROPRIATING $10,000.00 THEREFOR, AND PROVIDING FOR THE ISSUANCE OF $9,500.00 IN GENERAL UTILITY BONDS OR NOTES OF THE BOROUGH OF BARNEGAT LIGHT TO FINANCE THE SAME.

 

 

The Clerk read the above and the Mayor announced it is time to consider same for passage on second reading according to law.  Reynolds moved to open public hearing, seconded by Howard and carried by all.  There were no public comments, so on a motion by Warr, seconded by Morrison and carried by all the public hearing was closed. Spark moved to adopt, seconded by Morrison.

        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

            COUNTY OF OCEAN, STATE OF NEW JERSEY,

PROCLAIMING JUNE AS CELEBRATE NEW JERSEY MONTH

 

     WHEREAS, since earliest times, New Jersey’s shore line, Pine Barrens, mountains and valleys have been recognized as places of great beauty rich in natural resources and an abundance of plant and animal species; and

 

     WHEREAS,  New Jersey was the “crossroads of the American Revolution,” having more encampments, skirmishes, headquarters, and impact on the civilian population than any other state, with Washington and his army fighting back and forth across the state for four long years, involving almost every village and hamlet in the state; and

         

     WHEREAS,  New Jersey’s illustrious history and citizens have changed the nation and the world, including such “firsts and bests” as the first state to ratify the U.S. Bill of Rights, the first railroad charter in the U.S., the nation’s first seaside resort, the first baseball game, two Tony-Award-winning regional theaters, and the first college football game; and

 

     WHEREAS,  life saving health care innovations were invented in New Jersey including ether, penicillin, early chemotherapy, cortisone, streptomycin and antihypertensive drugs; and

 

     WHEREAS,  such life enhancing developments were invented in New Jersey as the first sound motion picture, the first live TV transmission, the first long-distance direct dialing, the first touch-tone dialing, the first transatlantic fiber-optic cable, the first high-definition digital TV, the first bar code, the first production of safe, practical air conditioners of large spaces, the first electric light, the first phonograph, the first canned, condensed soups, the first mass produced, quick-frozen vegetables, the first canned beer, the first glass company, and the first cloverleaf traffic intersection; and

 

     WHEREAS,  New Jersey’s illustrious citizens include such greats as Thomas Edison, Walt Whitman, Frank Sinatra, President Woodrow Wilson, James Fennimore Cooper, Bruce Springsteen, Alice Paul, William Carlos Williams, Charles Lindberg, Meryl Streep, Paul Robeson, Joyce Carol Oates, Susan Sarandon, and Jackie Robinson; and

 

     WHEREAS,  New Jersey’s strength is its highly educated work force, its diversity and the resilience, ingenuity, creativity, and generosity of its citizens; and

 

     WHEREAS,  the Borough of Barnegat Light, County of Ocean, State of New Jersey is known for its pristine beaches, commercial fishing industry and the famous Barnegat Lighthouse.

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the  Borough of Barnegat Light, County of Ocean, State of New Jersey, that we declare June, 2005 as New Jersey’s first annual CELEBRATE NEW JERSEY! Month and direct all Borough agencies and authorities to participate in showcasing all that makes our town a great place to live and work.

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

SUPPORTING SENATE BILL S-1023 AND

ASSEMBLY BILL A-1835

 

 

 

     WHEREAS, Senate Bill S-1023 and Assembly Bill A-1835 have been introduced for the purpose, in part , of requiring the State to reimburse municipalities for the reimbursement and payment of property taxes that disabled veterans are exempt from payment; and

 

     WHEREAS,  the bills also require the governing body of each municipality to return all taxes collected on the veteran’s property after the effective date of the determination of total disability from the United States Department of Veteran’s Affairs, and require the State to reimburse municipalities for the amount of such property taxes returned to a totally disable veteran pursuant to the requirements of this bill; and

 

     WHEREAS,  the Board of commissioners of the Borough of Barnegat Light recognizes the bravery of the men and women in our armed services and pay homage to them for the service to our Country at a great sacrifice to their health and welfare that they gave so valiantly for the freedom that we all experience and enjoy today; and

 

     WHEREAS,  the exemption of the property tax for the 100% disabled veterans, while justified, does possess a burden to the municipalities and seriously impacts the citizens of the Borough who would have to bear the burden of this exemption without the reimbursement from the State of New Jersey.  

         

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, that it does hereby support strongly the passage of Senate Bill S-1023 and Assembly bill a-1835 for the reasons set forth herein and urges all municipalities of the State to resolve to support passage of said legislation. 

    

     BE IT FURTHER RESOLVED that the Municipal Clerk forward a copy of this Resolution to Acting Governor Codey; 9th, 10th and 30th District Legislators; and all Ocean County Municipalities.

RESOLUTION 05-107

 

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

SUPPORTING A PERMANENT AND CONSTITUTIONALLY

GUARANTEED 20% REDUCTION IN PROPERTY TAXES

 

     WHEREAS,  New Jersey has some of the highest property taxes in the United States; and

 

     WHEREAS,  property taxes have increased by 6.3 percent statewide in the past year alone, with many towns experiencing increases of 10 percent or more; and

 

     WHEREAS,  the state government has provided only marginal amounts of state aid for property tax relief in the past three years, and may be providing no increase in state aid this year; and

 

     WHEREAS,  the ever increasing property tax burden is making it difficult for families to afford living in our communities and is particularly troublesome for seniors living on fixed incomes; and

 

     WHEREAS,  all of these factors combined justify calling the current situation a property tax crisis; and

 

     WHEREAS,  it is the responsibility of the Legislature to address problems of this magnitude; and

 

     WHEREAS,  Assembly Republicans have proposed a Blueprint for Property Tax Reform to provide direct property tax relief; and

 

     WHEREAS,  the plan provides a permanent 30% reduction in property taxes that is constitutionally guaranteed and phased in over three years; and

 

     WHEREAS,  the plan places constitutionally-established restraints on taxes and spending so budgetary savings and revenue growth will be the preferred means to pay for property tax relief; and

 

     WHEREAS,  the plan includes tools local governments can use to economize and keep taxes and spending in check.

         

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, that we urge the New Jersey State Legislature to adopt amendments to the state constitution that are proposed by the Blueprint for Property Tax Reform so they are placed on the ballot in 2005 and voters can decide whether direct and meaningful property tax relief should begin 2006; and

 

     BE IT FURTHER RESOLVED that we urge the New Jersey Legislature and Acting Governor Richard J. Codey the series of bills contained in the Blueprint for Property Tax Reform so municipalities can use these tools to control taxes and spending.  A certified copy of this resolution shall be sent to the Assembly Speaker Albio Sires, Assembly Minority Leader Alex DeCroce and all state legislators representing our legislative district.
