MAYOR AND COUNCIL MEETING    BARNEGAT LIGHT  MARCH 21, 2007

 

THE CAUCUS MEETING of the Mayor and Council was called to order by    Mayor Larson at 7:30pm at the Borough Hall, on West 10th Street. He stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 2, 2007 and by mailing a copy of the notice to the Beach Haven Times and Asbury Park Press, newspapers designated by Mayor and Council on January 2, 2007, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 2, 2007.

The Mayor asked if anyone had anything for caucus.  Councilwoman Reynolds said she had an objection to the resolution about an Amicus
Brief regarding Avalon.  She felt that some of the information in the resolution was incorrect after checking with Todd Plover (Piping Plover) about some of the proposed regulations.  The rest of the council said then we would table the resolution and probably not bring it up again.  The Mayor asked if everyone had seen the school budget we received from SRSD and all had.  Perhaps we can have a special meeting regarding the report from Mr. Ciccone (who should have his preliminary review wrapped up by April 1st) and possible have Lynn Shugars, Business Administrator from SRSD address us.  On a motion by Reynolds, seconded by Mikuletzky and carried by all there was a brief recess.

       

THE MEETING of the Mayor and Council was called to order by Mayor Kirk Larson, at 8:00am at the Borough Hall, on West 10th Street. The Mayor stated that adequate notice of this meeting has been provided in accordance with the New Jersey Open Public Meetings Act by transmitting notice of same to the Beach Haven Times and the Atlantic City Press on January 2, 2007 and by posting a copy of the notice of this meeting on the bulletin board in the Borough Hall on January 2, 2007 Said news papers were designated by Mayor and Council on January 2, 2007, to receive such notice, and by filing a copy of the notice with the Borough Clerk on January 2, 2007.

INTRODUCTION 2007 MUNICIPAL BUDGET:

 

Municipal Budget of the Borough of Barnegat Light, County of Ocean for the Fiscal Year 2007.

 

Be it Resolved, that the following statements of revenues and appropriations shall constitute the Municipal Budget for the year 2007k.

 

Be it Further Resolved, that said Budget be published in the Beach Haven Times in the Issue of March 28, 2007.

 

The Governing Body of the Borough of Barnegat Light does hereby approve the following Budget for the year 2007.

COMMITTEE REPORTS:

 

 

PUBLIC SAFETY:  COUNCILMAN MORRISON was absent.   The Mayor asked that the Court Report be made a part of the minutes.

 

DOCKS AND HARBORS: COUNCILMAN MIKULETZKY said all is ready at the Docks. All the money is in and Nancy is waiting for some people to turn in their proof of insurance.  

 

BEACHES AND PARKS:  COUNCILWOMAN REYNOLDS read a request from Freedom Surf Shop to have their Skim Board contest on June 23rd and 24th at 9th Street.  Reynolds moved to allow, seconded by Mikuletzky and carried by all.

 

FINANCE:  COUNCILMAN WARR said the Introduction of the budget was his report.

 

PUBLIC WORKS:  COUNCILMAN HOWARD was absent.

 

WATER/SEWER: COUNCILMAN SPARK asked that the monthly report be made a part of the minutes. 

 

0PEN PUBLIC SESSION:  On a motion by Reynolds, seconded by Mikuletzky and carried by all, the public session was opened.  Dick Malacrea mentioned that Barnegat got refunds from Southern Regional.  Frank Byrne said there is a big bottle type of thing attached to something on the beach between 22nd and 24th Streets.  Also at the base of 23rd Street there is a roll of dune fencing that is getting buried by the sand.  We will take care of both.   Tom Stiles mentioned the success of Operation Snowflake and what a success it was.  There was a round of applause for Tom and all he had done for Operation Snowflake.  He also mentioned that Ellen from the Liquor Store was very involved with him for the project. On a motion by Warr, seconded by Reynolds and carried by all the meeting was once again closed.

ORDINANCE 07-02

 

AN ORDINANCE OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 167 OF THE BOROUGH CODE, ENTITLED “STORMWATER CONTROL.”

 

The Clerk read the above by title and number and the Mayor announced it is time to consider same for passage on second reading according to law.  Reynolds so moved, seconded by Mikuletzky to open public hearing on ordinance and carried by all.  Dave Bossi asked a question about the swamp pink.  Being no further comment, on a motion by Mikuletzky, seconded by Reynolds the public hearing was closed.  Reynolds moved to adopt, seconded by Mikuletzky .

RESOLUTION 2007-54

 

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

OPPOSING THE DETAILED PRINTING ASSOCIATED

WITH STORM WATER REGULATIONS

 

     WHEREAS, the New Jersey Department of Environmental Protection has promulgated storm water management regulations in accordance with the laws of the State of New Jersey; and

 

     WHEREAS, these regulations are to be adopted by each municipality through the ordinance process as part of Land Use Documents of the individual jurisdictions as a Storm Water Management Plan; and

 

     WHEREAS, the existing New Jersey Land Use Act NJSA 40:55D provides for the referencing by citation of all such regulation as New Jersey Administrative Code (NJAC); and

 

     WHEREAS, the Department of Environmental Protection has determined and directed all individual jurisdictions must, to be compliant with the objectives of the Plan, print, not reference by citation, these regulations in their entirety; and

 

     WHEREAS, this uncustomary directive would also require the reprinting, in their entirety, any future amendments or supplements to such regulations; and

 

     WHEREAS, such detailed regulation are readily available to the public through professional or internet access; and

 

     WHEREAS, the cost to property tax payers of this directive, notices and printing and reprinting have not been determined.

 

     NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of  Barnegat Light, County of Ocean, State of New Jersey, as follows:

 

1.                                      That ever mindful of the property tax burden of local jurisdiction, the Mayor and Council of the Borough of Barnegat Light opposes and respectfully urges that the directive to print storm water regulations in their entirety as directed by the NJ Department of Environmental Protection be rescinded as an acknowledgement and recognition of unwarranted, unnecessary and inefficient enforcement policy.

 

2.                                      Further, that the Mayor and Council of the Borough of Barnegat Light shall forward a certified copy of this resolution to the following:

RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT,

COUNTY OF OCEAN, STATE OF NEW JERSEY,

AMENDING INTERLOCAL AGREEMENT FOR CONSTRUCTION

CODE SERVICES

 

 

 

     WHEREAS, the Borough of Barnegat Light entered into an Interlocal Services Agreement with the Boroughs of Beach Haven, Harvey Cedars and Surf City for the provision of construction Code Services; and

 

     WHEREAS,  certain amendments to Schedule C need to be made to this agreement.

         

 

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey that the attached Schedule C is hereby approved, effective January 1, 2007.  

    

 

     BE IT FURTHER RESOLVED that copies of this resolution with the schedules referred to above shall be sent to the Boroughs of Beach Haven, Harvey Cedars and Surf City.

IN THE AMOUNT OF $783,387.93

 

 

          WHEREAS, the Finance Committee of the Borough of Barnegat Light has examined the vouchers presented for payment,

 

          NOW, THEREFORE, BE IT RESOLVED, that the approved vouchers amounting to $783,387.93 be authorized to be paid upon verification of the Treasurer that there is sufficient money in the appropriated accounts, subject to adequate signatures and funding.

     WHEREAS,  N.J.S.A. 40A:4-8 provides that the budget be read by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full governing body, providing that at least one week prior to the date of hearing  a complete copy of the approved budget as advertised has been posted in the Borough Hall and copies have been made available by the Clerk to persons requiring them; and

    

     WHEREAS,  these two conditions have been met;

 

    

     NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

                        RESOLUTION OF THE BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE EXECUTION OF A three year COLLECTIVE BARGAINING AGREEMENT WITH THE TEAMSTERS LOCAL #35 FOR 2007 through 2009.

 

                        WHEREAS, the Borough of Barnegat Light and the Teamsters #35 entered into collective bargaining negotiations with regard to the terms and conditions of employment for the employees of the Barnegat Light Public Works Department for 2007 through 2009; and

                        WHEREAS, the parties have reached a settlement with regard to the same; and

                        WHEREAS, it is the desire of the Mayor and Borough Council to have executed a complete form of the Collective Bargaining Agreement between the parties.

 

                        NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Barnegat Light, County of Ocean, State of New Jersey, as follows:

                        1.         That the Borough of Barnegat Light does hereby authorize the execution of the Collective Bargaining Agreement between the Borough of Barnegat Light and the Teamsters Local #35, said agreement being attached hereto.

                        2.         That the Mayor and Borough Clerk are hereby authorized to execute any and all documents necessary to give effect to said Agreement.

Thank you was read from Lou Gura of the BLTPA thanking the Mayor for thinking of them to get out the word on the recent natural gas problem. Also There is an LBI Family Walk sponsored by the LBI Health Department on April 21st and also free cancer screenings to women on April 10, 17 and May 8.
